1. Overview
This website is operated by Ecphory LLC ("Ecphory," "we," "us," or "our"). By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions.
2. Eligibility
You must be at least 18 years old to make a purchase on this site.
3. Products & Availability
All candles, room sprays, and fragrance products sold by Ecphory are hand-poured and made in small batches in Nokomis, Florida. Because of this, slight variations in color, scent throw, and appearance are normal and not considered defects. We reserve the right to limit quantities, discontinue products, or modify recipes/scents at any time without notice.
4. Pricing & Payment
All prices are listed in USD and are subject to change without notice. We reserve the right to refuse or cancel any order for any reason, including errors in pricing or product listings, or suspected fraud. Payment is processed securely at checkout; we do not store your full payment card information.
5. Shipping
Shipping timeframes and costs are outlined separately in our Shipping Policy. We are not responsible for delays caused by carriers, customs, or events outside our control.
6. Returns & Refunds
Our Return & Refund Policy governs all return, exchange, and refund requests. Please refer to that page for full details before purchasing.
7. Candle Safety
Customers are responsible for following the burn instructions provided with each candle. Never leave a burning candle unattended, always burn on a heat-safe surface, and keep away from children, pets, drafts, and flammable materials. Ecphory is not liable for damage or injury resulting from improper or negligent use of our products.
8. Fragrance & Allergen Disclaimer
Our products contain fragrance oils and may contain common allergens. If you have sensitivities to fragrance, essential oils, or skin-contact products, please review ingredient information before purchasing or discontinue use if irritation occurs. Ecphory products are not intended to diagnose, treat, cure, or prevent any illness.
9. Disclaimer of Warranties
Our products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
10. Intellectual Property
All content on this site — including our logo, product names, descriptions, photography, and the Ecphory name and "Lighting a Memory" tagline — is the property of Ecphory LLC and may not be reproduced or used without written permission.
11. User Conduct
You agree not to use this site for any unlawful purpose or to violate any applicable laws, to infringe upon our intellectual property, or to submit false or misleading information when placing an order.
12. Limitation of Liability
Ecphory LLC, its owners, and employees shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website, to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify and hold harmless Ecphory LLC, its owners, and employees from any claim or demand, including reasonable attorneys' fees, arising out of your use of our products or your violation of these Terms.
14. Force Majeure
Ecphory LLC is not liable for any failure to perform due to causes beyond our reasonable control, including but not limited to natural disaster, shortage of materials, or carrier delay.
15. Governing Law & Jurisdiction
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Sarasota County, Florida.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms of Service at any time. Continued use of our site after changes are posted constitutes acceptance of the revised terms.
